Safe Holiday : Cooking The Turkey

With the turkey dinner just days away, it's important that consideration go into how the turkey is prepared.

The turkey should be thawed completely.
Enough time must be allowed to cook a whole turkey. (A 20-pound turkey needs two to three days to thaw completely when thawed in the refrigerator at a temperature of no more than 40 degrees Fahrenheit. A stuffed turkey needs 4 ¼ to 5 ¾ hours to cook completely).
A food thermometer should be used so to ensure that 165-180 degrees Fahrenheit is achieved.

Car/Bus Accident In Rochester

Wednesday night, there was a car/ school bus collision in Rochester. On the school bus were 22 students from Wabasha-Kellogg school district which collided with a U-turning vehicle. Eight students were taken to Saint Marys Hospital. The two people in the vehicle were also taken to the hospital. One occupant of the vehicle was air lifted by mayo one and the other was taken by ambulance. The incident is still under investigation.

In covering a past collision the Pioneer Press had an extensive list of bus accidents in the State:

March 19, 2009: An 81-year-old woman dies after crashing into a Northfield, Minn., school bus. She had failed to stop at a stop sign.

May 23, 2007: A 6-year-old boy waiting for his bus in downtown St. Paul is crushed to death after he falls under the wheels of a school bus carrying fellow students.

May 17, 2007: A 14-year-old Scandia girl and the man driving her home from school die when their minivan crashes into the back of a school bus stopped along a northern Washington County road. Eleven students riding the bus are uninjured; the bus driver suffers minor injuries.

Jan. 31, 2007: Seven people are injured, including five students, when a St. Francis school district bus crosses the center line, colliding with a car and flipping onto its side.

Dec. 8, 2006: A school bus loses control at Minnesota 65 and Constance Boulevard in Ham Lake. The bus clips a station wagon and broadsides an SUV before slamming into a traffic-signal pole, injuring 24. The bus driver said the accident was caused by brake failure.

Sept. 15, 2006: A St. Paul elementary school bus lands in the middle of Interstate 94 in rush-hour traffic. A low gas tank caused the bus to stall and roll backward. A child is taken to the hospital with minor injuries.

June 2, 2006: An empty school bus strikes and kills a boy crossing a street on his way to school in Rice Lake, Wis.

March 30, 2006: Two Chaska High School students are injured when the car they are riding in collides head-on with a school bus.

While the collisions all could have been worse, it is always scary for any parent to hear that a school bus is involved. The most resent research indicates that 17,000 children end up in the emergency room each year after being injured on the bus. Hopefully, more consideration will be given to adding seat belts to these buses.

The National Highway Traffic Safety Administration provides a nice handbook that all children should review and parents should talk to them about. Each of my boys seemed to get something from it. I want to make sure on those days they take the bus they get back safely.

Stork Craft Recalls 2.1 Million Drop Side Cribs

Today, The U.S. Consumer Product Safety Commission and Stork Craft Manufacturing Inc., of British Columbia, Canada recalled 2.1 million Stork Craft drop-side cribs. drop-side plastic hardware can break, deform, or parts can become missing. In addition, the drop-side can be installed upside-down, which can result in broken or disengaged plastic parts. All of these problems can cause the drop-side to detach in one or more corners. When the drop-side detaches, it creates space between the drop-side and the crib mattress. The bodies of infants and toddlers can become entrapped in the space which can lead to suffocation. Complete detachment of drop-sides can lead to falls from the crib.

CPSC, Health Canada, and Stork Craft are aware of 110 incidents of drop-side detachment; 67 incidents occurred in the United States and 43 in Canada. The incidents include 15 entrapments; 12 in the U.S. and three in Canada. Four of the entrapments resulted in suffocation: a 7-month-old in Gouverneur, N.Y.; a 7-month-old in New Iberia, La.; a 6-month-old in Summersville, W.Va.; and a 9-month-old in Bronx, N.Y. Included in these incidents are 20 falls from cribs; 12 in the U.S. and eight in Canada. Fall injuries ranged from concussion to bumps and bruises.

The cribs involved in these incidents had plastic drop-side hardware that had broken, missing, or deformed claws, connectors, tracks, or flexible tab stops; loose or missing metal spring clips; stripped screws; and/or drop-sides installed upside-down.

The cribs were sold at major retailers including BJ’s Wholesale Club, J.C. Penney, Kmart, Meijer, Sears, USA Baby, and Wal-Mart stores and online at Amazon.com, Babiesrus.com, Costco.com, Target.com, and Walmart.com from January 1993 through October 2009 for between $100 and $400.

This recall includes Stork Craft cribs with manufacturing and distribution dates between January 1993 and October 2009. This recall also includes Stork Craft cribs with the Fisher-Price logo that have manufacturing dates between October 1997 and December 2004. The Stork Craft cribs with the Fisher-Price logo were first sold in the U.S. in July 1998 and in Canada in September 1998. The cribs were sold in various styles and finishes. The manufacture date, model number, crib name, country of origin, and the firm’s name, address, and contact information are located on the assembly instruction sheet attached to the mattress support board. The firm’s insignia “storkcraft baby” or “storkling” is inscribed on the drop-side teething rail of some cribs. In Stork Craft cribs that contain the “Fisher-Price” logo, this logo can be found on the crib’s teething rail, in the manufacturer’s instructions, on the assembly instruction sheet attached to the mattress support board, and on the end panels of the Twinkle-Twinkle and Crystal crib models.The cribs were manufactured in Canada, China and Indonesia.

Consumers should immediately stop using the recalled cribs and wait for the free repair kit, and do not attempt to fix the cribs without the kit. They should find an alternative, safe sleeping environment for their baby. Consumers should contact Stork Craft to receive a free repair kit that converts the drop-side on these cribs to a fixed side. Wright County Head On Collision Kills Teenage Driver

Saturday evening, a head on collision in Wright county killed a teenage driver. He had been driving a westbound 1998 Toyota Camry that hit a eastbound 2001 Chevrolet Silverado pickup.The collision was reported at 6:25 p.m. Saturday on Wright County Road 35, near Jamison Avenue.

The county sheriff is still investigating the cause of the impact.

This death, was the second reported highway death this past weekend. The tragedy comes two months after the Minnesota Department of Public Safety (MDPS) reported that overall the number of highway deaths has been down for 2009 with more than 300 people having died this year in Minnesota traffic collisions. There were 458 deaths in 2008, which was a drop from 510 in 2007.

As with any death in a Minnesota motor vehicle collision, there are many issues that will need to be reviewed. My partner, Joe Crumley, addressed this topic in a recent article for the Minnesota Lawyers Trial magazine. I was interviewed last year on the same topic. In this accident sorrow for the families and friends of those involved goes out.

Minnesota Association For Justice's Statement On AP Medical Malpractice Poll

ASSOCIATED PRESS POLL: MAKE IT MORE DIFFICULT TO SUE FOR MEDICAL ERROR

Minnesota legal group says the AP poll oversimplifies the malpractice debate and ignores accountability of insurers and providers.

(Minneapolis, MN)- The Minnesota Association for Justice (MNAJ) responded to results released today from an Associated Press (AP) poll which claims that a majority in the U.S. approve of stricter controls on individuals seeking accountability for medical malpractice as inaccurate, misleading and does little to enhance the debate on health care reform.

Michael A. Bryant an attorney practicing in Minnesota and the current President of the Minnesota Association for Justice said the poll, conducted by Stanford University and the Robert Wood Johnson Foundation for the AP, “asks the question in a way that the respondent is to believe that limits on malpractice accountability would substantially lower consumer insurance and health care costs in the United States. The problem is there is simply no evidence to support either outcome.”

Claims that restricting legal remedies for medical malpractice would lower insurance rates for physicians and hospitals is in direct conflict with data released last month by the Medical Liability Monitor, a respected annual publication of malpractice rates across the country. The Medical Liability Monitor’s research show that there is no relation to rates between states that cap damage awards and states that don’t—and in many cases states that limit damages actually have significantly higher premiums.
“This poll distracts from concrete facts that show that limiting our ability to be fully compensated for negligent sub-standard medical care will not result in insurance premiums reductions,” Bryant added.

Minnesota does not limit the amount of actual damages a jury can award, and in 2008, ranked 50th lowest in medical malpractice insurance premiums. Minnesota’s courts have seen a 40% decline in medical malpractice filings, while leading the nation in many health care outcome measures.

“As the debate on health care reform heats up in the coming days, policy makers must embrace a comprehensive set of solutions that focus on quality care, patient safety, accountability for providers and insurers, and protection of all patients in the health care system.” Bryant stated.

Friday: Minnesota Winter Awareness Week - On the Road

Sponsored annually by the Department of Public Safety Division of Homeland Security and Emergency Management (HSEM), last week was Winter Awareness Week. Each day was devoted to a different topic concerning winter safety. To help with the effort, cities across the state are holding forums, providing daily winter safety tips and publicizing the effort in local newspapers and on city websites.

The week is broken down as:

Day 1 Surviving Winter Weather
Day 2 Outdoor Safety
Day 3 Fire Safety
Day 4 Indoor Air Issues
Day 5 On the Road

The Minnesota Safety Council recommends the following tips:

Make sure your car is ready for the season. Throughout the winter, keep your gas tank at least half full to avoid gas line freeze.
Avoid traveling, especially alone, if severe weather is threatening.
Before taking a trip, inform someone at your destination of your expected arrival time and your travel route.
Stock your car with basic winter driving equipment: a scraper and brush, small shovel, jumper cables, tow chain and a bag of sand or cat litter for tire traction. Also include road flares, a blanket, heavy boots, warm clothing, and a flashlight with batteries.
Keep an emergency survival kit in the car, including high-energy food such as a chocolate bar or energy bar.
If your car has been outside during a snowfall, brush all the snow off before starting out. Snow left on the front hood will blow into the front vent and cause defrosting problems, and can also melt and re-freeze on the windshield. Snow on the roof will cover the rear window and snow on the rear deck will blow onto tail lights. Pay particular attention to cleaning off headlights and tail lights so that other motorists can see you.
Adjust your speed to the conditions and increase following distances.
Remember that bridges and overpasses can be more slippery than other parts of the road. If you begin to skid, remain calm, ease your foot off the gas and turn your wheels in the direction you want the front of the car to go. If you have an anti-lock braking system (ABS) apply a steady firm pressure to the brake pedal. Never pump ABS brakes.
If even after following all precautions you find yourself stranded, stay calm and stay put. Staying in your car will decrease your risk of frostbite or hypothermia and increase your chances of being rescued. Run your engine for heat about once an hour, (every half hour in extreme cold.) Make sure your exhaust pipe is clear to prevent the back up of carbon monoxide. Leave one window slightly open. Tie a piece of brightly colored cloth to your antenna to alert others and aid rescuers. Limit your sleep to short naps.
Consider keeping a cellular phone for use during emergencies. For long trips, be sure the batteries are fully charged and consider bringing a spare battery. Keep the phone and batteries warm to avoid quick power drain. Because driving requires your full attention, it is recommended that you find a safe place to pull off the road when you need to make a call.

Identifying the reason behind the week the HSEM press release identified the issues:

Over the last 10 years, more than 50 people drowned after falling through thin ice, and 65 percent of ice drownings were vehicle related. Last winter, 22 people died in snowmobile accidents; half those fatal events involved alcohol or drug use. And during 2005–2007 in Minnesota, officers reported snow or icy road conditions in nearly 41,000 crashes that resulted in 159 deaths and 13,000 injuries. Clearly, people are being “surprised” by weather conditions."

The plan is, no matter how harsh the winter, to make sure everyone is safe and alive at the end of it.

The Attacks On The Health Care Plan: Looks Like They Were Planned Out

Are you torn with all of the health care debates? What is being talked about and what isn't? Who is behind what and what do the leaders of our country really want to do? Who has bought off who and why is anyone saying that they would rather keep things the way they are?

I've talked to enough people about this issue to know that many people are confused about why this is such a battle. Why the plan isn't just to sit down and to work something out and get a plan put together. It's been interesting to discuss with people the role that trial lawyers are playing in the issue and also the roles of the insurance companies. I, like many of the people here at the Injuryboard, have been out front talking about the issues every chance we get.

What was illuminating was to run across the game plan of the opposition to any change. Rolling Stone recently uncovered this interesting memo:

The 10 Rules For The Stopping Of The "WASHINGTON TAKEOVER” Of Health care

(1) Humanize your approach. Abandon and exile ALL references to the “health care system.” From now on, health care is about people. Before you speak, think of the three components of tone that matter most: Individualize. Personalize. Humanize.

(2) Acknowledge the “crisis” or suffer the consequences. If you say there is no health care crisis, you give your listener permission to ignore everything else you say. It is a credibility killer for most Americans. A better approach is to define the crisis in your terms. “If you’re one of the millions who can’t afford health care, it is a crisis.” Better yet, “If some bureaucrat puts himself between you and your doctor, denying you exactly what you need, that’s a crisis.” And the best: “If you have to wait weeks for tests and months for treatment, that’s a health care crisis.”

(3) “Time” is the government health care killer. As Mick Jagger once sang, “Time is on Your Side.” Nothing else turns people against the government takeover of health care than the realistic expectation that it will result in delayed and potentially even denied treatment, procedures and/or medications. “Waiting to buy a car or even a house won’t kill you. But waiting for the health care you need – could. Delayed care is denied care.”

(4) The arguments against the Democrats’ health care plan must center around “politicians,” “bureaucrats,” and “Washington” … not the free market, tax incentives, or competition. Stop talking economic theory and start personalizing the impact of a government takeover of health care. They don’t want to hear that you’re opposed to government health care because it’s too expensive (any help from the government to lower costs will be embraced) or because it’s anti-competitive (they don’t know about or care about current limits to competition). But they are deathly afraid that a government takeover will lower their quality of care – so they are extremely receptive to the anti-Washington approach. It’s not an economic issue. It’s a bureaucratic issue.

(5) The health care denial horror stories from Canada & Co. do resonate, but you have to humanize them. You’ll notice we recommend the phrase “government takeover” rather than “government run” or “government controlled” It’s because too many politician say “we don’t want a government run health care system like Canada or Great Britain” without explaining those consequences. There is a better approach. “In countries with government run health care, politicians make YOUR health care decisions.THEY decide if you’ll get the procedure you need, or if you are disqualified because the treatment is too expensive or because you are too old. We can’t have that in America.”

(6) Health care quality = “getting the treatment you need, when you need it.” That is how Americans define quality, and so should you. Once again, focus on the importance of timeliness, but then add to it the specter of “denial.” Nothing will anger Americans more than the chance that they will be denied the health care they need for whatever reason. This is also important because it is an attribute of a government health care system that the Democrats CANNOT offer. So say it. “The plan put forward by the Democrats will deny people treatments they need and make them wait to get the treatments they are allowed to receive.”

(7) “One-size-does-NOT-fit-all.” The idea that a “committee of Washington bureaucrats” will establish the standard of care for all Americans and decide who gets what treatment based on how much it costs is anathema to Americans. Your approach? Call for the “protection of the personalized doctor-patient relationship.” It allows you to fight to protect and improve something good rather than only fighting to prevent something bad.

(8) WASTE, FRAUD, and ABUSE are your best targets for how to bring down costs. Make no mistake: the high cost of health care is still public enemy number one on this issue – and why so many Americans (including Republicans and conservatives) think the Democrats can handle health care better than the GOP. You can’t blame it on the lack of a private market; in case you missed it, capitalism isn’t exactly in vogue these days. But you can and should blame it on the waste, fraud, and abuse that is rampant in anything and everything the government controls.

(9) Americans will expect the government to look out for those who truly can’t afford health care. Here is the perfect sentence for addressing cost and the limited role for government that wins you allies rather than enemies: “A balanced, common sense approach that provides assistance to those who truly need it and keeps health care patient-centered rather than government-centered for everyone.”

(10) It’s not enough to just say what you’re against. You have to tell them what you’re for. It’s okay (and even necessary) for your campaign to center around why this health care plan is bad for America. But if you offer no vision for what’s better for America, you’ll be relegated to insignificance at best and labeled obstructionist at worst. What Americans are looking for in health care that your “solution” will provide is, in a word, more: “more access to more treatments and more doctors…with less interference from insurance companies and Washington politicians and special interests.”

Reading this list, it seems clear that there are a group of people who don't want to get anything done. The people who ran the country for eight years and put profits in front of people and drove many parts of the economy into the dirt. It is made up of people who scream capitalism all the way to the bailout window. People who need to either come to the table and talk sense or get out of the way and let those who care about the consumer put together something that will truly make a difference.

Eden Prairie Crash Leaves One Dead

Friday night, A man died after his car going south on Flying Cloud Drive crossed into the northbound lanes and hit a another car head-on. The driver of the northbound car was hospitalized. There were also two minors that were passengers and said to be unharmed. Investigation continues as to what happened.

This death, like any other on Minnesota roads is particularly unfortunate considering it comes two months after the Minnesota Department of Public Safety (MDPS) reported that overall the number of highway deaths has been down for 2009 with more than 300 people having died this year in Minnesota traffic collisions. Passanger Dies In St Paul Collision

Mnday Afternoon, A 67-year-old woman died after a car in which she was riding turned in front of another vehicle at Larpenteur Avenue and Fernwood Street. The car was attempting to turn into a parking lot. The speed of the other car is being looked at.

Popular Food Can Make You Sick

This past week, the Center for Science in the Public Interest released the list of foods that have the most reported food illnesses. Unfortunately, they may be most people's favorites. This may mean a couple of things:

- All foods can make us sick

- That we don't do a very good job of preparing the foods we eat

- That the more mass produced a food product is, there may be more risks in those processes.

They found that since 1990 the top ten list was:

leafy greens were involved in 363 outbreaks and about 13,600 illnesses.
Eggs, involved in 352 outbreaks and 11,163 reported cases of illness.
Tuna, involved in 268 outbreaks and 2,341 reported cases of illness.
Oysters, involved in 132 outbreaks and 3,409 reported cases of illness.
Potatoes, involved in 108 outbreaks and 3,659 reported cases of illness.
Cheese, involved in 83 outbreaks and 2,761 reported cases of illness.
Ice cream, involved in 74 outbreaks and 2,594 reported cases of illness.
Tomatoes, involved in 31 outbreaks and 3,292 reported cases of illness.
Sprouts, involved in 31 outbreaks and 2,022 reported cases of illness.
Berries, involved in 25 outbreaks and 3,397 reported cases of illness.

The problems were mostly caused by norovirus, E. coli, and salmonella bacteria. Unfortunately, Smith DeWaal the CSPI's head of food safety programs, called the list "the tip of the iceberg" when it comes to food-borne illnesses in the U.S. Because, not all outbreaks are reported to public health authorities.

How do you protect yourself? Sarah Klein, lead author of the report recommends "defensive eating," including keeping food cold and cooking it thoroughly, chilling oysters and avoiding them when raw, and avoiding raw eggs or using them in homemade ice cream.
