The Bush administration has been using federal preemption to create complete immunity for many big business. In a long term research effort by the American Association for Justice, information has been uncovered through the FOIA which document meetings, emails and letters between Bush Administration officials and various businesses. Following these meetings, numerous agencies have made changes to their administration rules to preempt state laws.
The results are a complete loss of state protection for each consumer. These actions circumvent Congressional oversight and provide unprecedented protection for manufactures. In a report from the AAJ, their president stated: “Big business lobbyists have been on a crusade to destroy state consumer protection laws, and further stack the deck against American consumers,”
There is a reason that these changes are being done outside of the view of the consumer. There's a reason why these companies have been found by the Wall Street Journal to be purposely attempting to evade states protections. All answers are bad news for the consumers.

I am "Joe-the-average-citizen", and I live in Michigan, a State who, in 1995, granted the Drug Industry complete immunity from liability if their FDA approved drug harms or kills. Most of our citizens have no idea the Michgan's Drug Immunity Law even exists. And it's coming to a country near to your heart.America, beware of FDA preemption, or preemption in any disguise. Dress it up as "tort reform", make it over as "anti-frivolous-law-suit", sell it as "economically beneficial"...granting any industry total immunity is wrong and it is dangerous.
This action may be one of the greatest attacks on citizens rights to a civil trial ever taken. In The way it's been done should be even a greater concern. Thanks for taking the time to read my blog and post a comment.
Michigan's law was passed in the middle of the night, behind closed doors and tacked on to another bill. FDA preemption is being promoted quietly by the Bush administration and its Supreme Court. We need national media strength and attention Now. This Nov, 3 in Wyeth v Levine, the Supreme Court will rule on FDA preemption. Odds are, Levine wil lose.
Yes, this court is most likely going to go against the will of the jury and the state supreme court. State's rights are very much under attack , along with individuals rights. The midnight legislation is so troubling and such an indictment on those that push for this protection. There will be a number of things that will have to be addressed by the next administration. Hopefully the two month transition time won't be even worse for individual rights. Thanks for the comment.
